This project continues our interdisciplinary research into computational and cognitive aspects of narrative comprehension. Our ultimate goal is the development of a computational theory of how humans understand narrative texts. The theory will be informed by joint research from the viewpoints of linguistics, cognitive psychology, the study of language acquisition, literary theory, geography, philosophy, and artificial intelligence. The linguists, literary theorists, and geographers in our group are developing theories of narrative language and spatial understanding that are being tested by the (...) cognitive psychologists and language researchers in our group, and a computational model of a reader of narrative text is being developed by the AI researchers, based in part on these theories and results and in part on research on knowledge representation and reasoning. This proposal describes the knowledge-representation and natural-language-processing issues involved in the computational implementation of the theory; discusses a contrast between communicative and narrative uses of language and of the relation of the narrative text to the story world it describes; investigates linguistic, literary, and hermeneutic dimensions of our research; presents a computational investigation of subjective sentences and reference in narrative; studies children’s acquisition of the ability to take third-person perspective in their own storytelling; describes the psychological validation of various linguistic devices; and examines how readers develop an understanding of the geographical space of a story. This book deals with more than political philosophy in medieval Islam. The Islamic community was a religio-political unity, and as a consequence Islamic thought drew no clearcut distinction between what was strictly religious and what was political or legal. This makes it impossible to study its political ideas without delving into its thought in general and the evolution of its institutions and legal systems. In the debate between simple inference heuristics and complex decision mechanisms, we take a position squarely in the middle. A decision making process that extends to both naturalistic and novel settings should extend beyond the confines of this debate; both simple heuristics and complex mechanisms are cognitive skills adapted to and appropriate for some circumstances but not for others. Rather than ask `Which skill is better?'' it is often more important to ask `When is a skill justified?'' The selection and (...) application of an appropriate cognitive skill for a particular problem has both costs and benefits, and therefore requires the resolution of a tradeoff. In revisiting satisficing, we observe that the essence of satisficing is tradeoff. Unlike heuristics, which derive their justification from empirical phenomena, and unlike optimal solutions, which derive their justification by an evaluation of alternatives, satisficing decision-making derives its justification by an evaluation of consequences. We formulate and present a satisficing decision paradigm that has its motivation in Herbert Simon''s work on bounded rationality. We characterize satisficing using a cost–benefit tradeoff, and generate a decision rule applicable to both designing intelligent machines as well as describing human behavior. (shrink)

Cusanus, Abstract As a rule Cusanus is interpreted in a theological way, under strong theological presuppositions and within the range of religion. This may be quite understandable since he was a cardinal and had important functions in the Papal States. But, what are the results, when we read his texts under pure philosophical conditions? We may see then that some of his texts are meant neither to assert a belief nor to search for reasons for it, but only to reflect (...) upon the presuppositions of this belief and its different traditions. Instead of asserting his belief Cusanus is beginning to reflect upon his presupositions. We try to give an exemple for this shift with the first proposition in the collection of propositions that follow the dialog De non aliud: „definitio quae se et omnia definit, ea est, quae per omnem mentem quaeritur.“ We will see a quite another Cusanus. Cusanus picks up „definitio“ in the sense of self-determination, developped in the dialog. He begins in quite a traditional manner and ends in a supremely abstract and speculative intuition. The 'Not-other' determines itself in a vision; this vision is an order in which every thing gets its proper place; we as human beings aspire to repeat this vision in our mental life in contact with the world. In this way Cusanus does what all great philosophers do: he reflects in a given set of opinions what is the meaning of „to be“. (shrink)

The present text is the revised and corrected English translation of the book published in German by the Lang Verlag, Bern 2008. Unfortunately the text still has some minor flaws (especially in the Index Locorum) but they do not concern the main thesis or the arguments. It will still be the final version, especially considering my age. It is among the most widespread and the least questioned convictions that in Metaphysics Lambda Aristotle presents a theology which has its basis in (...) a metaphysics of substance. Doubts about theological interpretation are beginning to stir in a growing number of publications, but nevertheless the majority of research literature, compendiums and histories of philosophy argues within this frame. A closer look at the facts reveals that this conviction has no basis in the text. Quite the contrary it is based on a reception with theological interests. It arised over centuries, starting from Patristic times and the Middle Ages; it was influenced by Neoplatonic texts as the Liber de Causis or the Theologia Aristotelis, texts for a long time considered as original Aristotelian books. And, if you read not translations but the Greek text, you see that the word 'god' occurs much less than in a theological book should be. In some translations we find more occurences of that word, and especially in French, Italian, English translations some words as le Bien, l'Intelligence etc. are written with capitals to inticate that it is about god. To make it even more clear, we read often the term 'First Mover' or 'Unmoved Mover' as an other name for god, but this expression is never used by Aristotle. So the reader has the impression that Aristotle speaks continuously about god. In addition, in the present book you will find arguments which clean up with the outdated concept of substance in the Aristotelian text, a concept which was developed for quite other problems than Aristotle had, namely theolgical ones. And, if there is no substance, there is no corresponding metaphysics of substance and no theology or onto-theology. If substance, metyphysics, theology play no role in Metaphysics Lambda, what else is its content and aim? That is not so difficult to say because Aristotle says it sufficiently clear in his first sentence, περὶ οὐσίας ἡ θεωρία: our inquiry is about being; its aim is to develop the Frage nach dem Sein and to state a speculative answer: being is noesis, Sein ist Gewahren. Combinatory logic started as a programme in the foundation of mathematics and in an historical context at a time when such endeavours attracted the most gifted among the mathematicians. This small volume arose under quite differ ent circumstances, namely within the context of reworking the mathematical foundations of computer science. I have been very lucky in finding gifted students who agreed to work with me and chose, for their Ph. Globalisation Considering the Multitude of Worlds This book deals with globalisation, its foundations, its rise and fall and the question of its future. It discusses the conditions that have led, each in its own way, to the reduction of the many worlds to one. The first foundations were laid in the time of the discoveries, the earth was recognised and measured as a unified space. Missionary work and colonisation have made the geographical unit into a unity of fundamental beliefs, values (...) and Western European languages. The brisk trade with the colonies also unified the financial and economic situation of the conquered foreign worlds, which were managed according to Western patterns. The small gain of the political independence of the states achieved in the decolonisation movement was unfortunately destroyed by the great losses already suffered in the area of the fundamental values of the original worlds, their languages, their ways of living, their faith. In the new situation it became apparent that the economic dependence on the former colonial states was increasing rather than decreasing, the way of doing politics had remained by habit that of the colonial powers. Decolonisation was not a way back to the old world. Two metaphysical assumptions of globalisation are discussed in more detail. One is the assumption of realism that the world is one. This assumption justifies missionary and colonialist action. On the other hand, there is the thesis of liberalism that the being of the beings is its economic value. Against the realistic assumption of the one world, arguments are put forward which justify and make plausible the opposite assumption of a multitude of worlds. Now that the world is de facto one thanks to globalisation, and now that it is suffering from problems that affect all people, a new kind of globalisation is needed, one that recognises and respects different worlds on the one hand, but is nevertheless capable of tackling environmental, financial and social problems together. Depending on the subject, two very different ways of reasoning are used. In the preparatory historical part, the arguments are empirical and stick to details; in the part dealing with the justification of the multiplicity of worlds, the argumentation is theoretical, not to say speculative. Clinical ethics consultation service remains undeveloped in developing countries. It is recognised that its introduction poses challenges. Malaysia, a multicultural society with diverse religions, values and perceptions further complicate the introduction of formal clinical ethics consultation service. Clinicians attending a national congress workshop completed a Strengths–Weaknesses–Opportunities–Threats analysis. The aim was to gain insight into clinician’s expectations and promote initiatives leading to the introduction of clinical ethics consultation service. Clinicians agree that clinical ethics consultation service can improve quality of care, reduce (...) healthcare costs and advocate for patients and providers. The analysis highlighted constraints in sufficient critical mass of relevant expertise and restricted opportunities for training. _Why originalism is a flawed, incoherent, and dangerously ideological method of constitutional interpretation__ “Chemerinsky... offers a concise, point-by-point refutation of the theory [of originalism]. He argues that it cannot deliver what it promises—and if it could, no one would want what it is selling.”—David Cole, _New York Review of Books__ Originalism, the view that the meaning of a constitutional provision is fixed when it is adopted, was once the fringe theory of a few extremely conservative legal scholars but is now (...) a well-accepted mode of constitutional interpretation. Three of the Supreme Court’s nine justices explicitly embrace the originalist approach, as do increasing numbers of judges in the lower courts. Noted legal scholar Erwin Chemerinsky gives a comprehensive analysis of the problems that make originalism unworkable as a method of constitutional interpretation. He argues that the framers themselves never intended constitutional interpretation to be inflexible and shows how it is often impossible to know what the “original intent” of any particular provision was. Perhaps worst of all, though its supporters tout it as a politically neutral and objective method, originalist interpretation tends to disappear when its results fail to conform to modern conservative ideology. The highest percentage is obtained by the christian-democratic parties: 58%; the lowest by the last remaining communists: 27%.The preferential v'ótes individual candidates obtain differ widely. This is not only a result of their popularity, but also of their political position, rendering of services and media-attraction. Preferential voting is characteristic to politically conscious voters. The sociography of the Belgian post-war minister is characterized by an upper middle-class or middle-class origin, a French-speaking and male preponderance and a university-education. The most frequent professional occupations are lawyer, professor and executive.The political career which led to a ministerial post, went in the first place through the legislative body and in the second place through thepolitical parties. After their ministerial career 39 % of the ministers played a promine part in the parliament; 35 %, however, prosecuted an extra-parliamentary (...) and prestigious « after-function ».The Belgian ministerial career pattern bears some resemblances to the Dutch, German and French career pattern, but also many differences. The most outstanding difference is the importance of the bureaucratic component in the structure of the ministerial elite in those three countries, where in Belgium this is not very important. The European Union is working towards harmonizing legislation across Europe, in order to improve cross-border interchange of legal information. This goal is supported for instance via standards such as the European Law Identifier and the European Case Law Identifier, which provide technical specifications for Web identifiers and suggestions for vocabularies to be used to describe metadata pertaining to legal documents in a machine readable format. Notably, these ECLI and ELI metadata standards adhere to the RDF data format which forms the (...) basis of Linked Data, and therefore have the potential to form a basis for a pan-European legal Knowledge Graph. Unfortunately, to date said specifications have only been partially adopted by EU member states. In this paper we describe a methodology to transform the existing legal information system used in Austria to such a legal knowledge graph covering different steps from modeling national specific aspects, to population, and finally the integration of legal data from other countries through linked data. We demonstrate the usefulness of this approach by exemplifying practical use cases from legal information search, which are not possible in an automated fashion so far. (shrink)

The article examines the legal status of living wills and health care proxies in Germany, the United States and Japan. The investigation begins with the question of what protection these three legal orders provide for the right to self-determination. Whereas in Germany and the United States, legislation and legal practice take the theory of informed consent very seriously, the doctor-patient relationship in Japan is much less oriented toward the idea of patient autonomy. This basic attitude is reflected in the legal (...) disposition given advance directives. In the USA, most of the individual states have legislation on the living will and health care proxies. In Germany, the judiciary and scholarly literature at least carefully affirm that they are legally binding. In Japan, at least currently, there is nothing at all similar to this approach. The authors then conduct a micro-legal comparison of cases of first impression decided in the USA and Germany and emphasize the amazing similarity of the judicial decisions in two cases . Finally, the question is raised for German law of whether, and in what form, further legislative development of the judicially established right to die appears reasonable. Der vorliegende Beitrag untersucht den rechtlichen Stellenwert von living wills und health care proxies in Deutschland, in den USA und in Japan. Ausgangspunkt der Untersuchung ist die Frage, welchen Schutz das Selbstbestimmungsrecht in den erwähnten Rechtsordnungen genießt. Während in Deutschland und in den USA Gesetzgebung und Rechtspraxis die Theorie vom informed consent sehr ernst nehmen, ist das Arzt-Patienten-Verhältnis in Japan weit weniger vom Gedanken der Autonomie des Patienten bestimmt. Diese Basiswertung schlägt auch im Bereich der rechtlichen Beurteilung von advance directives durch. In den USA sind living will und health care proxy in den meisten Einzelstaaten gesetzlich geregelt, in Deutschland wird ihre rechtliche Verbindlichkeit von Judikatur und Literatur zumindest vorsichtig bejaht. In Japan fehlen - zumindest derzeit - entsprechende Ansätze noch gänzlich.Die Verfasser stellen sodann einen Mikrorechtsvergleich zwischen den in den USA und in Deutschland entschiedenen cases of first impression an und betonen den erstaunlichen Gleichklang der rechtlichen Beurteilung dieser beiden Fälle .Schließlich wird für deutsches Recht die Frage gestellt, ob - und in welcher Form - eine legislative Weiterentwicklung des judiziell bereits etablierten right to die angemessen erschiene. Modern animal rights debates began in the 1970s, mainly as part of the budding field of applied ethics in Anglo-American philosophy. In just a short time, these animal rights discourses received international academic respect, especially through analytically trained philosophers. Central for this development was the analysis that rights language can be principally used species neutrally. This paper’s contribution is to examine the central terms of Tom Regan’s still widely discussed theory for their actuality and usefulness. With the advent of the relativity theory science has entered a transformative period in which previous certainties are undergoing critical scrutiny and renovation. Critical movements in science arise at periods of its history when its foundations are brought into question. True it is that natural philosophers still regard science as a growing body of propositions dealing with natural events enabling them to find the structural laws of the external world. But this “external world” about them changes in significance, interpretation, and (...) meaning as new epoch-making theories are propounded and experimental verification of some of their consequences tend to give them scientific plausibility. It is evident to every earnest thinker that a theory of time is in a very significant sense implicit in any philosophy of nature. Indeed, the search for a time standard independent of the variation of the earth's speed, the maximum variation being slightly more than one-thousandth of a second, involves the most basic concepts and principles of physical theory.

It is 50 years since the first Nobel Prize in economics was awarded to Jan Tinbergen and Ragnar Frisch. This article analyzes the collaborations between these pioneers of econometrics which spanned four decades and various subfields in economics, based on records of their correspondence. It is demonstrated that, while Frisch was largely responsible for theoretical breakthroughs, Tinbergen was responsible for making them public and popularizing them. This is especially relevant for understanding the development of econometric models in the 1950s, decision (...) models of the 1950s, and subsequent work on utility measurement. This division of labor is analyzed in relation to the goals they pursued in their research and their respective perfectionistic and pragmatic approaches to economic science. Both men shared a sense of deep social responsibility, but differences in their personalities and approaches to science generated important differences in scientific recognition and policy influence. Although they are both widely remembered for helping to turn economics into a quantitative empirical science, this article shows that they were motivated by separate personal and political goals which shaped their scientific approaches. In a thought-provoking article – or how she herself named it, ‘a thought experiment’ – the philosopher-medical ethicist Anna Smajdor analyzed in this journal the idea of whole-body gestational donation (WBGD) in brain-dead female patients, as an alternative means of gestation for prospective women who cannot or prefer not to become pregnant themselves. We have serious legal, economical, medical and ethical concerns about this proposal. First, consent for eight months of ICU treatment can never be assumed to be derived from (...) consent for post-mortem organ donation; these two are of an incomparable and entirely different medical and ethical order. Moreover, the brain-dead woman is very likely to be medically unfit for high-tech surrogacy and the brain-dead state poses a high risk for deficient embryo/fetal development. Second, from a scarcity perspective, occupying an ICU bed for eight months appears to be unjust. The costs for eight months of ICU treatment are far too high compared to the costs of surrogacy for a living, selected, and healthy woman. Neither insurance companies nor prospective parents will want to pay these exceptionally high costs for a dead woman if a living surrogate mother can be hired for a considerably lower amount. Third, there is an increased risk for harm of the child to be in WBGD. And finally, WBGD risks violating the brain-dead woman’s dignity and harming the interests of her loved ones. In short, there is simply no need for brain-dead women as surrogates. (shrink)
